Terms of Service

Welcome to 404 Company Not Found LLC ("404 Company Not Found LLC," "we," "us," or "our"), the company behind the PistePal mobile application. These Terms of Service ("Terms") govern your access to and use of the PistePal mobile application, website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you have the legal capacity to enter into these Terms and that all information you provide is accurate and complete.

2. Account Registration and Security

To access certain features, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • Restricting access to your device
  • All activities that occur under your account

You agree to notify us immediately of any unauthorized use of your account or breach of security.

3. Subscriptions and Billing

404 Company Not Found LLC offers premium features in the PistePal app through paid subscriptions. By purchasing a subscription, you agree that:

  • Billing is handled by the app store associated with your device (Apple App Store or Google Play)
  • Subscriptions automatically renew unless you cancel at least 24 hours before the current period ends
  • You can manage or cancel your subscription through your app store account settings
  • No refunds are provided for partial subscription periods, except where required by law

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Harass, abuse, or harm other users
  • Share false, misleading, or inappropriate information
  • Attempt to gain unauthorized access to the Service or interfere with its operation
  • Reverse engineer, modify, or create derivative works based on the Service

5. Mountain Safety and Assumption of Risk

Skiing, snowboarding, and all mountain activities are inherently dangerous and can result in serious injury or death. The Service is provided for informational purposes only and is not a substitute for official trail maps, signage, weather reports, avalanche forecasts, or instructions from resort staff and public safety authorities. By using the Service, you acknowledge and agree that:

  • You participate in all mountain activities at your own risk and remain solely responsible for your decisions, physical condition, equipment, and compliance with all posted warnings and laws.
  • Maps, routes, directions, terrain data, weather information, and other content may be inaccurate, incomplete, outdated, or unavailable. Conditions can change rapidly in alpine environments.
  • The Service does not monitor real-time emergencies, provide rescue services, or guarantee that help will reach you. Always contact ski patrol or emergency services directly if you need assistance.
  • You must independently verify conditions, obey closures, and use proper safety gear and navigation tools even when using the Service.

6. Location Sharing

The Service provides optional real-time location sharing. You control when and with whom your location is shared. You are responsible for managing your sharing preferences and understanding that sharing your location can reveal your real-world whereabouts.

7. Intellectual Property

The Service, including all content, features, and functionality, is owned by 404 Company Not Found LLC or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

8. Third-Party Services

The Service may integrate with or link to third-party services. Your use of third-party services is governed by their own terms and privacy policies. We are not responsible for the content or conduct of third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 404 COMPANY NOT FOUND LLC AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify, defend, and hold harmless 404 Company Not Found LLC and its affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorney fees) arising out of or related to your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users or the Service.

13. Changes to the Service and Terms

We may modify or discontinue any part of the Service at any time. We may also update these Terms to reflect changes in our practices or applicable laws. We will notify you of material changes by updating the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in New York County, New York.
